Terms of Use

The following Terms of Service statement ("TOS") describes your rights and obligations in the use of the TotallyTickets.com website ("Web Site"). Please read the TOS carefully before proceeding. 

1. ACKNOWLEDGMENT AND ACCEPTANCEOF TERMS OF SERVICE:
The following is a list of the terms specified in the Terms of Service agreement. 

2. DESCRIPTION OF SERVICE:
Totally Tickets Inc. is a ticket broker selling seats at market value, not face value. Face value is the price printed on a ticket; market value is a price determined by the supply and demand for a particular event. The market value may be higher, lower or the same as face value. All ticket purchases will be assessed a service charge, a shipping fee if applicable and Oklahoma state sales tax if applicable. **Tickets are priced at the current market value and are subject to change at any time without notice. Totally Tickets Inc. is not responsible for any damage incurred to your tickets after they are delivered to you. Tickets cannot be replaced if they damaged, lost or stolen. In the unlikely event there are any discrepancies with the tickets received, you must contact Totally Tickets Inc. within 48 hours of delivery. All event times listed on our site are local times for that event. Dates and times are subject to change and should be verified by the buyer the day before the event. We will not issue a refund in the event of a time change. Certain events may have minimum age requirements. It is the responsibility of the purchaser to confirm age eligibility for attendees prior to purchase.
Totally Tickets Inc. owns many of the tickets we sell. To provide coverage for events for which we may not yet own tickets, we list tickets from a network of reliable suppliers. Web orders must be confirmed with our supplier by our Web Sales Department. Once confirmed, we will ship your tickets immediately or notify you when the tickets will be ready to ship. If we are unable to confirm your tickets, you will be offered the choice of comparable replacement tickets at the current market price (pending availability) or a 100% refund. If a ticket price or event is listed incorrectly due to an error by our supplier, the order will be cancelled and a 100% refund will be issued. Totally Tickets makes all best efforts to describe any obstructions or limited views with regards to seating. Anytime a ticket is marked obstructed or limited view, we will fully disclose this in our notes before the time of sale. However, Totally Tickets has no way of knowing how a particular band or act will set up their stage, and therefore can not guarantee each and every seat purchased. The buyer agrees that Totally Tickets best efforts are enough to satisfy them and they release Totally Tickets from any warranty or claim both express or implied regarding such seating.

3. ONLINE ORDER CONFIRMATION:
Online orders are processed and confirmed during normal business hours, Monday-Friday 8:30am-5pm CST. Any orders placed after 4pm CST may not be guaranteed an order confirmation until the following business day.

All online orders are confirmed via email or a phone call. You are responsible for providing an accessible email address and phone number that allows our staff to provide you with the confirmation. [Note: some email addresses have a spam blocker which may prevent delivery of your order confirmations].

If you have placed an order and received a Web reservation number then you will immediately receive a ticket request confirmation email. Your confirmation will state that your order has been received and will be processed immediately. [Note: if you are shipping to an address other than the billing address provided on your order, you may be required to provide further information before your order can be confirmed]. If you do not receive an invoice or have not been contacted by a Totally Tickets representative within 2 business days of placing your order please contact our office to check the order status.

Gift cards are given away as promotional items and are not available for purchase. Gift cards or gift codes are limited to two per transaction. Gift cards balances may not be combined into one balance.

If your tickets are "in hand" and ready to be shipped, a FedEx or USPS tracking number for you to track your package will be included on the invoice emailed to you. It is your responsibility to check the tracking status of your tickets. If your package is not tracking with FedEx or USPS please call our office to speak with a representative who can then check the shipping status.

4. MODIFICATIONS TO TERMS OF SERVICE:
TotallyTickets.com may amend this Terms of Service at anytime, without notice to the user. 

5. DISCLAIMER OF WARRANTIES:
The web site and associated services are provided on an "as is" and "as available" basis and user expressly agrees that use of the web site and associated services is at user's sole risk. Totally Tickets Inc. expressly disclaims all warranties of any kind, whether express or implied, including, but not limited to, warranties of merchantability, fitness for a particular purpose and non-infringement. User understands and agrees that User bears sole responsibility and risk for the accuracy, reliability, currentness or completeness of the information, materials and/or data that user displays, downloads or otherwise obtains through the use of the web site and associated services ("content"). User will be solely responsible for any damage to user's computer system or loss of data resulting from displaying, downloading or otherwise obtaining such information, materials and/or data except as expressly set forth herein, Totally Tickets Inc. makes no warranty regarding any goods or services purchased or obtained through the web site or any transactions entered into through the service. No advice or information, whether oral or written, obtained by User from Totally Tickets Inc. or through the service shall create any warranty obligation on the part of Totally Tickets Inc. not expressly made herein. Some jurisdictions do not allow the exclusion of certain warranties, so some of the above exclusions may not apply. 

6. LIMITATION OF LIABILITY:
Totally Tickets Inc. shall not be liable for any direct, indirect, incidental, special, consequential or exemplary damages that arise out of or in connection with
(a) any errors, inaccuracies, omissions. defects, untimeliness or lack of authenticity of any contents on this web site;
(b) the user’s use or inability to utilize this web site or any content therein;
(c) the cost of procuring substitute goods or services;
(d) defects in any goods, materials, data, information or services purchased or obtained or data received or transactions entered into through the service;
(e) unauthorized TotallyTickets.com versions or the alteration of user's transmissions or data; or
(f) any other matter relating to the web site and associated services including but not limited to, damages for lost profits, loss of use, loss of data or other intangible property, even if Totally Tickets has been advised of the possibility of such damages. Some jurisdictions do not allow the limitation or exclusion of certain liabilities, so some of the above limitations may not apply.

7. NO RESALE OR COMMERCIAL USE OF THE SERVICES PROVIDED VIA THE WEB SITE:
User's right to use the Service is personal to User. User agrees not to reproduce, duplicate, copy, sell, resell, license or exploit the Web Site and associated services, or use the Web Site or associated services for any commercial purposes, except to engage in the purchase of entertainment packages and/or the purchase or sale of tickets via the Online Auction feature of the Web Site. 

8. USER CONDUCT:
User agrees to abide by all applicable local, state, national, and international laws and regulations in User's use of the Web Site and associated services. User agrees to be solely responsible for User's actions while using the Service. User agrees not to (a) interfere with another User's use and enjoyment of the Web Site and associated services; (b) impersonate any person or entity, including but not limited to, an official, guide or host of Totally Tickets Inc..; (c) falsely state or misrepresent User's affiliation with a person or entity. User further agrees not use the Service to post, promote or transmit any material (a) that is unlawful, harassing, libelous, abusive, threatening, harmful, vulgar, obscene, hateful, racially, ethnically or otherwise objectionable material of any kind or nature; (b) that encourages conduct that could constitute a criminal offense, give rise to civil liability or otherwise violate any applicable local, state, national or international law or regulation; or (c) that is protected by copyright, trademark or other proprietary right of any third part 

9. TERMINATION OF SERVICE:
User agrees that Totally Tickets Inc. may terminate User's use of the Service or refuse to allow future use of the Service, for any reason, including without limitation. User acknowledges and agrees that termination of service under any provision of this TOS may be effected without prior notice. User acknowledges and agrees that immediately upon such termination, User shall immediately discontinue use of the Web Site and we may delete and discard all information and files in User's account and bar any further use of our site. 

10. RETURNS AND EXCHANGES:
Totally Tickets Inc. reserves the right to cancel all orders that have not been shipped or processed. We have the final say on ticket availability and the buyer or "user" has no claim to the tickets until they receive them from us. All orders are final and orders can only be returned/exchanged if the event is cancelled (not postponed.) If an event is cancelled and not rescheduled, you will receive a refund for the total of your order, less shipping costs. *You must return your tickets to Totally Tickets Inc. within seven (7) days of cancellation of the event in order to receive a refund. All returns due to cancellations must include a tracking number. Ticketfast tickets cannot be returned or exchanged for any reason after receipt due to security concerns.

11. SHIPPING:
Due to the nature of the ticket industry, we do reserve the right to deliver tickets for any order as late as the day of the event. Last minute delivery service for delivery the day of the event may include but are not limited to: Will Call at the venue box office, secured courier to a hotel, or delivering tickets via an affiliate at a location outside the venue to be determined. If tickets have not been delivered within two days before the date of the event, please call our office at 866.848.8499 from 9am to 6pm EST, Monday through Friday, to receive delivery instructions. Photo ID may be required to accept deliveries in person.

When a buyer pays shipping charges, that DOES NOT mean that your tickets will be shipped out immediately. 

Totally Tickets Inc. is not responsible for delivery delays due to weather conditions, an act of God, or any other delay not caused by Totally Tickets Inc. Please keep your tickets in a safe place. Totally Tickets Inc. is not responsible for lost, stolen, damaged or destroyed tickets. Please note that direct sunlight or heat can damage certain types of tickets.

12. FEES:
We may charge service, shipping, delivery, fulfillment or other fees for using our Services (collectively referred to as 'Service Fees'). All service fees will be displayed on the checkout page before orders are placed. Service fees are based upon variable rates per ticket. Rates are based on cost of ticket acquisition, processing, fulfillment, delivery and applicable sales taxes. Service fees are calculated per ticket and lumped together as one fee on TotallyTickets.com. Service fees are included in the ticket price and not displayed separately on invoices from Totally Tickets. If you wish to receive an invoice displaying the service fees on a per ticket basis please contact Totally Tickets. In addition, we may collect amounts owed using a collection agency or other collection mechanism and you may be charged fees associated with collecting the delinquent payments. Totally Tickets, or the collection agency it retains, may also report information about your account to credit bureaus, and as a result, defaults in your account may be reflected in your credit report. If you wish to dispute the information Totally Tickets reported to a credit bureau, contact Totally Tickets. If you wish to dispute the information a collection agency reported, contact the collection agency directly.

Discount/Coupon codes and Reward Points do not apply to service fees. Reward Points are earned per service fee dollar but cannot be redeemed on service fees. Service fees are calculated before Discount/Coupon codes are applied to the ticket price.

Totally Tickets Inc. is not responsible for delivery delays due to weather conditions, an act of God, or any other delay not caused by Totally Tickets Inc. Please keep your tickets in a safe place. Totally Tickets Inc. is not responsible for lost, stolen, damaged or destroyed tickets. Please note that direct sunlight or heat can damage certain types of tickets.

13. PRIVACY POLICY
Totally Tickets Inc. has created this privacy statement in order to demonstrate our firm commitment to privacy. The following discloses the information gathering and dissemination practices for this website.

In some cases we require visitors to give us contact and personal information. This information is used only in replying to inquiries or processing orders. Our site has security measures in place to protect against loss, misuse and alteration of the information under our control. We are the sole owner of any personal information we receive. Furthermore, we will NOT sell, share or rent ANY of the information that visitors provide us with.

We collect the following information from all visitors to our site: the name of the domain through which they access the Internet; the date and time they access the site; and the web page that referred them to our page. We use this information to administer our website and to help diagnose and troubleshoot potential server malfunctions. We also record the individual (IP) address of the computers used to access our site in order to protect against fraud.

14. CONSENT TO JURISDICTION AND FORUM SELECTION:
The parties hereto agree that all actions or proceedings arising in connection with this Agreement shall be tried and litigated exclusively in the State and Federal courts located in the County of Cleveland, State of Oklahoma. The aforementioned choice of venue is intended by the parties to be mandatory and not permissive in nature, thereby precluding the possibility of litigation between the parties with respect to or arising out of this Agreement in any jurisdiction other than that specified in this paragraph. Each party hereby waives any right it may have to assert the doctrine of forum non conveniens or similar doctrine or to object to venue with respect to any proceeding brought in accordance with this paragraph, and stipulates that the State and Federal courts located in the County of Cleveland, State of Oklahoma shall have in personam jurisdiction and venue over each of them for the purpose of litigating any dispute, controversy, or proceeding arising out of or related to this Agreement. Each party hereby authorizes and accepts service of process sufficient for personal jurisdiction in any action against it as contemplated by this paragraph by registered or certified mail, return receipt requested, postage prepaid, to its address for the giving of notices as set forth in this Agreement. Any final judgment rendered against a party in any action or proceeding shall be conclusive as to the subject of such final judgment and may be enforced in other jurisdictions in any manner provided by law.
